I don’t know enough about the ACA compliance process to know if this is legal or not, so I’m going to take your word for it that it is.

If it matters, my work does offer health insurance and I do use it. The second is a typical administrative assistant-type role — more entry-level, with a salary to reflect that. Do you think it’s nobody’s business, or is it, since I’m presumably affecting their day-to-day life with my coughing?
