My boss is advertising my job because I got sick before some pre-approved vacation time. When I returned to work on Wednesday, I found a sent email (everyone in my office shares one email account) from my boss to our advertising partner asking to place an ad in the paper for an office admin (my job). Is this legal?

At my work, we are currently in-between team leaders, and the position is being advertised. However, the person checking my references (not the hiring manager but another employee) has been asking my references if they can give them contact information for another person who can speak to my work ethic.

Not to mention, the actual job title was being falsely advertised, which in turn was not a marketing job but rather an administration one. His work ethic is still superb, but it has been difficult working around his new schedule. Is this legal? Sure, it’s legal. If the latter, tell him no, period.
